Foundation and Goal: Invading borders is the most historical threat against International Order. This action shows a violent behavior or resort to pressure of one state owning a sovereignty power against a weak state. However, since ground invasion threatens the rights of states having sovereignty and the applied goal is to preserve the legal independence of members of International society, this action is considered as a threat to International Order. Therefore, the members of International society decided to handle and combat against this action.
Method Research: Current study uses library documents and sources and descriptive-analytic method.
Findings and results: One of the ancient principles of International Law is the equality of sovereignty of states. Based on this principle, states must apply their own principles regarding their own international borders. Historically, invading this principle and intervention in sovereignty of other states will ve done resorting to military tools. Therefore, due to the occurrence of two world wars in first half of 20th century, different states prevented it. Finally, in Resolution 3314 of International Right, invading acts are regarded an International Crime. The definition of Commission is inserted to the bylaw in the first revision of International Criminal Court (2010) as a repetitious Article 8. Therefore, to preserve International Peace and Internal peace of different countries and to respect human right, invading acts (war), which is occurred by passing international borders, is considered as crime. Secular element of this intervention is military forces of a state combating against sovereignty of another state, land entirety or political independence of another state and or every other kind which is incompatible with Charter of United Nations Organization.
